Why do we process your data?

OSBORNE DISTRIBUIDORA S.A. will process the data providing for the following reasons:

- Processing of the personal information relating to the management and service of people requesting visits to the winery.

- Sending out the newsletter and commercial information by post and/or electronic means

- To generate, after sending out the newsletter, analysis on browsing and usability of the website and detecting sales generated to determine the preferences and sales profiles, and to tailor the responses to client preferences, create statistics and detect deficiencies to improve the website processes.

Legitimization

What is the legitimization of the processing of your data?

The legal bases that apply to the processing of your data are the following:

- Contract or legal relationship in the case of visits where the purpose ends in the purchase of ticket: article 6.1. b) of the European General Regulations on Data Protection.

- Consent for profiles to be created of preferences and navegation analysis: art. 6.1.a) of the European General Regulations on Data Protection.

- Consent and/or legitimate interest in the receiving the newsletter and commercial information: article 6.1.a) and 6.1.f) of the European General Regulations on Data Protection.

Recipients

Who do we share your data with?

- Personal data will only be shared the companies that make up the OSBORNE Group, and when necessary to fulfil legally established obligations or to support services linked to the data processing and its aims.

- If the delivery of services requires data to be shared with service providers within and outside the European Union that support the management of this processing, this will only be done with with members that are members of the USA-European Union privacy Shield and that fulfil sufficient guarantees in terms of confidentiality and security in terms of data processing. Specifically, the delivery of services linked to this treatment is provided by the use of the computer-based client management platform Salesforce, which complies with Binding Corporate Rules that allow it to export personal data to organizations within the Salesforce Group located outside the European Economic Area, that have been approved by the data protection authorities of Frnace, Holland and Bavaria in Germany. The Salesforce platform has also been accepted into the North-American Privacy Shield system and OSBORNE and Salesforce have signed a binding contractual agreement based on the model approved by the European Commission (https://eur-lex.europa.eu/legal-content/ES/TXT/PDF/?uri=CELEX:32010D0087&from=ES).

Retention

How long do we keep your data for?

-  The personal data is kept until you visit the winery.

-  The personal data relating to the mailing of commercial data is retained until the person unsubscribes or requests their removal.

Rights

What are your rights when you provide your details?

- Everyone has the right to obtain confirmation of whether OSBORNE is processing their personal data.

- The interested parties have the right to access their personal data, as well as request the correction of incorrect details and, where necessary, request their removal when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

- In certain circumstances, the interested parties can request the limitation of the processing of their data, in which case it will only be used for exercising or responding to complaints.

- In certain circumstances, and for reasons related to their personal situation, the interested persons can oppose the processing of their data. In this case, OSBORNE will stop processing the data, expect for legimately imperious reasons, or in exercising or responding to possible complaints.

- The interested parties can request the portability of the data to obtain the details that they have provided OSBORNE with in a structured format, for common use and in a machine-readable format, to be downloaded by the interested party or sent from OSBORNE to another entity.

- The interested party can exercise their rights by sending an email to rgpd@osborne.es

- They can lodge a complaint with the Data Protection Agency, particularly when they are not satisfied that their rights have been exercised, by contacting the postal and/or email address indicated on the website www.agpd.es.

Security

- The data will be processed in a confidential manner, submitted to adecuate technical and organisational safety measures to avoid its alteration, loss, treatment and unauthorized access.
